Without asking, my BIL put our address as his permanent in-state address with the DOH for Medicaid purposes. To be clear, he doesn't live here, never has lived here, never will live here! I'm not even really sure where he lives, somewhere in another state, and it's probably been a very long time since he had a permanent/stable residence anywhere in that state or this one. I think this constitues Medicaid fraud and I told dh to tell him I'm sending everything back marked "wrong address". He doesn't want him using our address but I'm not sure if he told him so. Dh agrees with me but I think he thinks I'm overreacting because I don't like BIL. He may be right to an extent. Do you think this is a moral and/or legal issue? Am I overreacting on the "Fraud" rationale?

Is there some difference in benefits for residents of your state? If this is an attempt to get better or different benefits then yes, it is fraud.

Your issue is rational. You don't want to defraud the government by knowingly allowing someone to falsify information. If he doesn't live there, or in the same state even, then its definitely a problem. What is his reason for still keeping medicaid in a state he doesn't live in? Sounds fishy. Granted, there are much more serious things, but regardless, it is wrong. If he doesn't have a permanent address he may be able to give them a p.o. box, or just keep updating his mailing address as he moves around. It's his problem if he wants to shortcut the system, don't make it yours also.

Personally, I'd go one step further and call DOH and let them know that, to the best of your knowledge, this person doesn't even live in the state. They can then investigate. What your BIL is doing is fraud and stealing, plain and simple. --Kat

I had no idea how to answer this question. I contacted the Medicaid Fraud unit of the Alabama Attorneys General office and was advised that this could indeed be Medicaid fraud if the BIL was receiving benefits from your state. I was also told you should contact your own state to find out what their rules and regulations were. I hope this helps.

Wow, qtman, you didn't have to research it for me. Thanks for the info. To be fair, and I should've mentioned, he was planning to move back to this state - NOT with us by any means! That lasted all of about a week. I just want no part of anything he does. My other big selfish concern was that now all his creditors are going to start calling here looking for him. His mother and other brother have both put dh's name on various things (like apt rental apps) and we get calls constantly because they don't pay their bills. I don't know if this BIL is receiving any benefits from this state or anything about it. I don't want to know.
